 Creative Potential Privacy Notice

This privacy notice explains how Creative Potential collects, uses and protects personal information when you contact me, use this website or commission consultancy work.

Creative Potential provides independent Behaviour & SEND consultancy for schools, including work around behaviour, regulation, learning access, SEND and SEMH.

When you contact me through this website or by email, I may collect:

• your name and contact details; 
• your school or organisation; 
• your role; 
• information you choose to include in your enquiry; and 
• documents or files you choose to send separately. 

Please do not send identifiable pupil information through the website contact form. Where pupil information is needed, I will agree an appropriate way for it to be shared.

Where a school commissions pupil-focused consultancy, I may receive information needed to understand the situation and carry out the agreed work. This can include:

• relevant school records, plans and assessments; 
• information about behaviour, regulation, attendance and access to learning; 
• SEND, SEMH, communication, sensory or health information where relevant; 
• information about provision and support already in place; 
• information shared by school staff, parents or carers and relevant professionals; and 
• other information reasonably required for the assessment or consultancy work. 

Some of this information may be sensitive or special-category personal data.

Pupil information may be:

• sent to my business Outlook email account; 
• shared through an agreed secure file-transfer service such as Egress; 
• provided as hard copies while I am working in school; 
• discussed with me during meetings or professional consultation; or 
• viewed by me in school without a copy being retained. 

I aim to use the minimum personal information necessary for the work being undertaken.

I use information to:

• respond to enquiries; 
• understand and agree the scope of work; 
• carry out commissioned assessments and consultancy; 
• review relevant information and prepare professional advice or reports; 
• communicate with the commissioning school and, where appropriate, relevant parents, carers or professionals; 
• arrange visits, meetings and follow-up work; 
• maintain appropriate professional and business records; and 
• meet legal, financial, safeguarding and professional responsibilities. 

Creative Potential is responsible for personal information used for my own website enquiries, business administration and professional records.

Where a school provides pupil information for commissioned work, the respective data-protection responsibilities of the school and Creative Potential depend on the nature of the work. The school will normally determine why pupil information is shared with me, and I use that information only for the agreed professional purpose. Where I create or retain my own professional records or reports, Creative Potential may also have responsibilities as a data controller.

These arrangements should be reflected in the commissioning agreement or other data-protection arrangements with the school.

I process personal information only where there is an appropriate lawful basis. Where information includes special-category data, an additional lawful condition is also required.

I do not sell personal information.

Information may be processed through services used to run Creative Potential, including website hosting, business email, secure file transfer and electronic storage.

Information relating to commissioned work may also be shared with the commissioning school and, where appropriate and agreed, relevant parents, carers or professionals where this is necessary for the work or required by law.

I do not share identifiable pupil information more widely unless there is an appropriate professional or legal reason to do so.

I take reasonable steps to protect personal information, including using appropriate business email and secure file-transfer methods, restricting access to records and handling hard-copy information carefully.

Where documents can appropriately be reviewed within the school without retaining a copy, I may do so.

I keep personal information only for as long as it is reasonably needed for the purpose for which it was collected.

Enquiry information that does not lead to commissioned work is not kept indefinitely.

Where work is commissioned, relevant records may be retained for an appropriate period to meet professional, safeguarding, insurance, legal and accounting requirements. Records are reviewed and securely deleted when they are no longer required.

Where appropriate, retention arrangements may also be agreed with the commissioning school.

Depending on the circumstances, you may have rights to:

• ask for access to personal information held about you; 
• ask for inaccurate information to be corrected; 
• ask for information to be deleted where the right applies; 
• ask for processing to be restricted; or 
• object to certain uses of your personal information. 

If your request relates to pupil information provided to me by a school, I may need to refer the request to the school where it is the relevant data controller.

You can also complain to the Information Commissioner’s Office (ICO) if you are concerned about how your personal information has been handled.
